    Presumption of Ownership

    If a foreign asset is held in the name of a relative, associate, or trust, and the taxpayer cannot explain the source, authorities may presume beneficial ownership. Under the Black Money Act, this presumption enables tax authorities to tax and penalize the individual as the true owner of the asset.
