    Fiduciary Capacity

    A fiduciary capacity is when one person holds property for the benefit of another under legal trust or obligation. Examples include trustees, partners, company directors, and legal guardians. In such cases, ownership is not considered benami under the Act, as the transaction lacks concealment or fraud intent. Fiduciary holdings are legally protected and exempt.
