Mens Rea (Intent)

Mens rea, or the intention to conceal ownership, is essential to establish a benami offence. The law penalizes individuals who knowingly hide real ownership to avoid taxes or scrutiny. However, transactions without malicious intent, such as gifts or fiduciary arrangements, are generally excluded. Proving intent helps differentiate criminal benami transactions from innocent ownership structures.
